The Customer declares to have read all the aforementioned information and general sales conditions, before placing the order.
General conditions of Sale
The present general conditions of sale (the “General Conditions”) govern the methods and conditions of sale of the products marketed by the Company Olivicola Petrazzuoli (the “Products”).
- “Supplier”: Azienda Olivicola Petrazzuoli owned by Dr. Giovanni Petrazzuoli, offers all users the possibility of buying its products through the internet site Petrazzuoli.com of which it is the sole and exclusive owner.
- “Customer”: the person who buys the products offered for sale on-line by the supplier as a consumer (a natural person acting for purposes not involved in his/her customary trade, business or profession – Article 3 of the Consumer Code – Italian Legislative Decree n° 206/05) or for purposes related to his/her trade, business or profession.
- “Conditions”: these terms and conditions of sale are applied by the Supplier exclusively in relationships with customers making on-line purchases.
If these conditions are changed, the conditions valid at the time of the customer sends the order shall be applied to the purchase.
The customer is required to read these terms and conditions carefully; they are available at petrazzuoli.com for reference at all times.
1. Products: prices and features
Unless otherwise indicated, the prices of the Products published on the website of the Azienda Olivicola Petrazzuoli are shown in Euros and include VAT. The price shown on the website at the time of the placing the order is applied. The purchase price is fixed and final. The prices of the Products published by the Azienda Olivicola Petrazzuoli on the site cancel and replace the previous ones and are subject to the actual availability of the Products. Product images are indicative and not-binding for the Supplier. The Customer is responsible for choosing the ordered Products.
2. Orders – invoicing
Each order of Products transmitted to the Azienda Olivicola Petrazzuoli constitutes the Client’s contractual proposal. By sending the order, the customer acknowledges and declares having read all the information provided during the purchase procedure and to accept these General Terms and Conditions of Sale in full. The tax documentation relating to the Products ordered will be issued by the Company Olivicola Petrazzuoli when the Products are shipped to the Customer. The Supplier will issue an invoice/receipt for products purchased sent to the Customer by e-mail. The invoice will be issued on the basis of the information (for billing and shipping address) provided by the Customer.
3. Execution of the order
The order will be executed within the terms specified on the Site. Normally deliveries are made within 7 working days for Italy for all Products indicated as “available”. Products offered for sale may occasionally be totally or partially unavailable. In such cases, the Supplier shall inform the Customer in a timely manner. The Customer will confirm his choice by e-mail, ie wait for the availability of the Product or request a refund.
4. Order acceptance
The order procedure is completed on receipt of the order by the Supplier. The customer will receive by email a notification of receipt indicating the order confirmation with all the elements constituting the contract (products selected, prices, delivery address and costs, order number ect.). Azienda Olivicola Petrazzuoli reserves the right not to confirm an order for any reason relevant in particular to a problem of supplying Products, or to a problem concerning the order received.
5. Delivery of Products
The Products are delivered to the address indicated by the Customer. Shipments will take place after receiving confirmation of payments; for the bank transfer, the credit in our current account is valid, for payment by credit card the confirmation of the transaction by the circuit. For our shipments we rely on the service of qualified express couriers such as SDA, GLS, BRT. Rates for Italy: tariff calculated based on weight: € 9.76 up to 3kg; € 14.03 up to 10kg; € 15.25 up to 20kg; € 15.86 up to 30kg; € 21.96 up to 50kg; € 32.94 up to 100kg. Delivery expenses are charged to the Customer and are appropriately highlighted in the order.
Delivery time
Normally deliveries are made within 7 working days for Italy only for the products available in stock. The shipping terms indicated on the site, although carefully evaluated, must be considered non-binding for the Azienda Olivicola Petrazzuoli, which can subsequently confirm or modify them, according to its actual needs. Delivery times are indicated in working days. The shipping term of an order containing items with different delivery times is equal to the longer shipping term of the items in order. Delays in deliveries less than 30 (thirty) days do not entitle the Customer to refuse delivery of the Products, nor to demand compensation of any kind. The Azienda Olivicola Petrazzuoli has the right to make, if it deems it appropriate, the delivery of the Products (also relating to the same order) in several successive deliveries. Delivery is considered to have been made when the Product is delivered to the Customer. The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the Product, will constitute a proof regarding the transport and release of the goods.
It is important to know that:
On delivery, the Customer must verify that packaging is intact, undamaged, neither wet nor otherwise altered, even as regards sealing materials. In particular, The Customer must check that the number of packages delivered corresponds to what is indicated in the document of shipping.
If there are any anomalies, the Customer may refuse delivery or put in writing his detailed and dated reservations. These reservations must be confirmed to the transporter by registered letter with return receipt within 3 (three) working days following the delivery of the Products. A copy will be sent to the Azienda Olivicola Petrazzuoli. If the delivery document is signed without reserve, it will constitute a proof concerning the transport and release of the goods. The Customer cannot raise any objection about the external aspects of the products delivered. Any problem concerning the physical integrity, correspondence or completeness of the Products must be reported within 3 (three) days from the delivery. Azienda Olivicola Petrazzuoli has the right, in its sole discretion, to deliver the Products ordered by a courier chosen by you. Unless otherwise indicated, all deliveries are made at street level. Specific terms and conditions of delivery must be agreed in advance between the Customer and Azienda Olivicola Petrazzuoli and accepted in writing by Azienda Olivicola Petrazzuoli.
6. Collection of products in the absence of the customer
In the absence of the recipient, the carrier will leave a notice of passage to the delivery address indicated by the Customer. The Products must be collected at the address and in the manner indicated by the carrier. In case of non-collection within the deadline set by the transporter, the Products will be returned to the Azienda Olivicola Petrazzuoli, which reserves the right to reimburse the price of the Products, while the shipping costs are charged to the Customer. If an error concerning the Product(s) occurs, the Customer undertakes to return the Product(s) to the Azienda Olivicola Petrazzuoli within 7 (seven) days from the receipt, in their original condition and packaging with the transport documents. Once the Product has been received and checked, Azienda Olivicola Petrazzuoli will make a new delivery of the Product(s) at its own expense.
7. Force majeure
The following cases are considered as cases of force majeure, in addition to those normally considered by the jurisprudence:
– total or partial strikes, internal or external to the company, suspension of transport or supply for any reason, governmental or legal restrictions, computer failures, blocking of telecommunications including networks and in particular the internet.
In the event of force majeure, the execution of the order will be initially suspended, in full right. If after a period of 3 (three) months, the parties ascertain the persistence of the case of force majeure, the order will be automatically canceled, unless otherwise agreed by both parties.
8. Right of withdrawal

According to the art. 5 of Legislative Decree 22 May 1999 n. 185, the Customer (if it can be qualified as a “consumer” pursuant to Article 1 letter b) of Legislative Decree 22 May 1999 n. 185) has the right to withdraw from the contract and to return the ordered Products, without any penalty and without specifying the reason, within 10 (ten) working days from receipt of the Products.

8.2
The right of withdrawal referred to in Article 9.1 above shall be exercised by the Customer, under penalty of forfeiture, by sending a registered letter a.r. to Azienda Olivicola Petrazzuoli, Via Scoccilli 27, 81010 Ruviano CE, Italy, within 10 (ten) working days from receipt of the Products.

8.3
All returns (which must be perfectly intact and accompanied by the original packaging) must be authorized by Customer Service (info@petrazzuoli.it). Once the return has been authorized, the Customer may return the Product to the following address: Azienda Olivicola Petrazzuoli, Via Scoccilli 27, 81010 Ruviano CE, Italy. Cash on delivery will not be accepted.

8.4
Once the Products have been received (and their integrity verified) Azienda Olivicola Petrazzuoli will credit the Customer with the cost of the returned Products (as indicated on the invoice) as soon as possible, retaining the amount of the shipping costs, charged to the Customer.

8.5
The right of withdrawal referred to in Article 8.1 above cannot be exercised by the Customer in the event that the Products purchased consist of bottles of oil that have been opened by the Customer himself or in case of a customised order. In case of damage to the goods during the transport for return, Azienda Olivicola Petrazzuoli will notify the Customer of the incident (within 5 working days from receipt of the good in its warehouses), to allow him to file a timely complaint against the courier and obtain reimbursement of the value of the asset (if insured); in this case, the Product will be made available to the Customer for its return, simultaneously canceling the request for withdrawal. Azienda Olivicola Petrazzuoli is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments. During the withdrawal period referred to in Article 15, the Customer is responsible for the object as guardian. In case of damage or destruction of the Product during the custody of the Customer, the right of withdrawal will expire.
9. Payment
Payment is due from the moment the order is made. The Customer undertakes to pay the agreed price for the Product ordered on the Site. The accepted methods of payment are: Paypal and bank transfer. The Customer guarantees the Azienda Olivicola Petrazzuoli the availability of any necessary authorizations to use the card payment method at the time of order, or by bank transfer in favor of the Azienda Olivicola Petrazzuoli. In the event that the Azienda Olivicola Petrazzuoli fails to receive the transfer within 10 days of confirmation of the order, the Azienda Olivicola Petrazzuoli reserves the right to cancel the order. The bank details are provided at the time of the order. The Customer guarantees to the Azienda Olivicola Petrazzuoli the fact of having the necessary authorizations to use the Paypal payment method when ordering.
10. Non-payment – Retention of title
The Products ordered are property of the Azienda Olivicola Petrazzuoli until full payment of their price (pursuant to Art. 1523 and following of the CC.). Azienda Olivicola Petrazzuoli reserves the right to claim the Products ordered in the event of non-payment.
11. Complaints
Claims for non-conformity of the Products delivered must be sent in writing directly to the Azienda Olivicola Petrazzuoli, immediately after receipt of the goods. The Customer must keep the original packaging and the delivery document.
12. Personal data processing
The computerized processing of information, including the management of e-mail addresses of site users, is carried out in accordance with the provisions of the law. The nominative information requested are essential for the processing and forwarding of orders, the creation of invoices and any warranty contracts. For this reason, these information may be communicated to the contractual partners of the Azienda Olivicola Petrazzuoli. The Customer may object to such communication and, pursuant to the law, avails itself of the right to access, modify, rectify and delete data concerning him by contacting Azienda Olivicola Petrazzuoli, Via Scoccilli 27, Ruviano (CE) Italy. 13. Electronic signature
The “click validation” constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.
14. Non-surrender
Azienda Olivicola Petrazzuoli reserves the right to assert a failure on the part of the Customer with regard to any of its obligations even at a later time, without this meaning renouncing its right.
15. Completeness of the contract
The present general conditions of sale constitute the entirety of the obligations of the parties. No other general or particular condition communicated by the Customer may be inserted or excluded from these general conditions.
16. Intellectual property
Azienda Olivicola Petrazzuoli owns the intellectual property rights of the Site and the right to distribute the elements contained in the catalogue of the online store. The partial or total reproduction, on any type of support, of the elements of the Site and the catalogue, their use as well as their transfer to third parties are formally prohibited.
17. Nullity
Should one or more provisions of these general conditions be considered or declared invalid in application of a law, regulation or following a final decision taken by a competent jurisdiction, the other provisions will retain all their strength and value.
18. Jurisdiction
In the event of a dispute and in the absence of an amicable agreement reached between the parties, without prejudice to the possible applicability of mandatory provisions of law for the protection of consumers (as defined pursuant to Article 1 letter b) of Legislative Decree 22 May 1999 n. 185), any dispute connected with these General Conditions, will be referred to the exclusive jurisdiction of the Court of Santa Maria Capua Vetere (CE).
